Judge extends Gilbane Federal’s term as EEMC
U.S. District Court for the NMI designated Judge David O. Carter granted last week the request of the U.S. and the CNMI governments and the Commonwealth Utilities Corp. to extend for one year the term of Gilbane Federal as the Engineering and Environmental Management Company that is tasked to oversee stalled CUC projects.
Carter extended the term of Gilbane Federal as EEMC to Feb. 5, 2021.
Gilbane Federal is a California-based construction company with 64 offices worldwide.
In 2014, Carter selected Gilbane Federal as an EEMC which would have the power to rapidly complete some stalled CUC projects or help CUC comply with court-mandated projects called Stipulated Order Number 2.
SO2 refers to projects that focus on oil issues and also apply to oil spills and the remediation of the contaminated power plants.
Carter said his 2015 order specifically authorizes extending EEMC’s term.
Carter said the parties described that the EEMC, under his guidance, provided substantial assistance with SO2 projects. Those projects include construction of the CUC pipeline and Tank 102, major repairs to Tank 103, and repair and construction of secondary containment at the CUC Power Plants in Lower Base.
EEMC’s assistance through Feb. 5, 2021, will hopefully assist with future projects, including one installing the incinerator unit at Power Plants 1 and 2, improvements at the Rota Power Plant, and improvements to facility drainage systems at Power Plants 1 and 2 and Power Plant 4.
U.S. Department of Justice Environmental Enforcement Section senior attorney Bradley O’Brien informed the court last week that the parties continue to make substantial progress in SO2, but more time is needed to complete the projects using the EEMS funds to the extent possible.
Then-CUC legal counsel James Sirok also informed the court last week that SO2 projects under the outstanding task orders are moving along on a timely basis without any major problems.
Gilbane Federal/EEMC principal Daryl Greenway recently disclosed that it has now completed seven task orders and made over $2 million in savings for CUC.
