Kan Pacific granted writ to sell IPI property

The U.S. District Court for the NMI has granted Kan Pacific Saipan Ltd.’s request for a writ of execution that authorizes it to sell Imperial Pacific International (CNMI) LLC property to satisfy an over $600,000 court judgment.

Chief Judge Ramona V. Manglona granted last Friday Kan Pacific’s application for a writ of execution on IPI’s personal property to satisfy a judgment of $697,801.30 plus post-judgment interest.

Specifically, Kan Pacific is now authorized to seize and sell IPI vehicles, liquor, the crystal dragons that decorate its cavernous lobby, casino-related equipment, and more.

“The court grants Kan Pacific’s application. It is therefore ordered that the clerk issue the writ of execution to the U.S. Marshal for the seizure of IPI’s vehicles, IPI’s liquor, IPI’s dragons, IPI’s computer hardware, IPI’s furniture, and equipment, IPI’s casino-related equipment and security equipment, and any and all other personal property of IPI as further identified in the application for the writ. The clerk shall also provide IPI notice of its rights. Once the U.S. Marshals Service executes the writ of execution, IPI may file, in writing, any exceptions. Such filing is due 14 days after execution of the writ,” said Manglona.

Previously, the court granted Kan Pacific’s motion for summary judgment based upon a breach of contract claim against IPI.

On Dec. 2, 2022, a judgment of $697,801.30, plus post-judgment interest, was entered in favor of Kan Pacific against IPI. Six months later, the court issued a writ of execution over IPI’s motor vehicles and heavy equipment to U.S.A. Fanter Corp., Ltd. a judgment creditor of IPI. Additionally, the court issued a writ of execution to Joshua Gray, another judgment creditor, over various IPI personal properties.

Recognizing that IPI’s vehicles are already subject to Fanter’s writ of execution, Gray sought “priority as to any unsold vehicles or funds still available after Fanter’s judgment is satisfied.”

In its application for a writ of execution, Kan Pacific acknowledges Fanter and Gray’s writs of execution and “seeks priority as to any unsold vehicles or funds still available after Fanter’s and Gray’s judgments are satisfied.”

After taking this into consideration, the court granted Kan Pacific’s request.

The former Mariana Resort & Spa in Marpi that was formerly owned by Kan Pacific Saipan Ltd.
