$20K bail for man who showed himself to minor
A 26-year-old man was imposed a $20,000 bail after he indecently exposed himself to a 13-year-old last Monday.
Jimmy Philip Kaipat appeared before Associate Judge Teresa Kim-Tenorio yesterday afternoon at the Superior Court in Susupe where he was charged with indecent exposure to the second degree and disturbing the peace.
Kim-Tenorio placed a $20,000 bail on Kaipat and ordered he be remanded back to the custody of the Department of Corrections. Kaipat is set to return to court on Sept. 25, 2024 at 9am for a preliminary hearing and on Oct. 7 at 9am for arraignment. Attorney Emily Thomsen from the Public Defender Office was assigned to defend Kaipat, with assistant attorney general Heather Barcinas representing the government.
Court documents state that on Monday, Sept. 16, around 1pm, DPS Central received a disturbance call from an apartment just behind Gold Beach Hotel on Beach Road, Garapan.
The caller, later identified as the victim’s mother, was reporting that an unknown male exposed his sexual organ to her 13-year-old daughter, as the girl was walking home from the bus stop.
The document further stated that when officers arrived and met with the mother, she escorted officers to her apartment where they saw the minor, a 13-year-old, with red teary eyes, appearing to have been crying. As the victim was having difficulty speaking, officers spoke with the mother while the minor tried to calm down.
The mother stated that her daughter stormed into the house scared and crying and she panicked and checked up on the daughter and asked what happened.
The girl told her that a local male came up to her and told her she was pretty and asked her to “suck his d.”
The girl told the male “no” and walked away, but the man said “no, please look” as he pulled his pants down and exposed himself to which the girl ran away, while he kept repeating his request.
The mother of the victim stated that she was scared for the minor’s safety and didn’t know if the man was still outside so she contacted police for assistance.
Officers spoke with the minor and she stated, “I got off from my school bus at the bus stop and walked the road to my house as I made a right turn on the rocky road, I saw a guy waiting at the end of the Gold Beach Hotel at the backside. I walked toward the area where the guy was waiting, and the guy said to me ‘Hi, you’re very pretty. Can you suck my d?’ I said no and walked faster to my house. Then he said ‘Please, please, wait, look at this.’ When I looked the guy had pulled his pants down and I saw his penis. I then walked faster, as he was walking toward me with his penis out of his pants and saying ‘Ay, ay please just suck my d. Please don’t call the police.’ I went home and cried to my mom and told her what happened.”
The victim described the male wearing a black T-shirt with black short pants and was seen behind the hotel. Officers in the area heard dispatch of the description of the male and was able to track Kaipat, wearing a black shirt and black pants standing outside of an apartment along Pupulu Drive.
Officers approached Kaipat informing him about the incident, and questioning him, to which Kaipat responded that he approached the girl and asked, “Do you want to make love?” Kaipat further stated that she said no, so he left her alone and then walked back to his apartment which was close by.
