Hllbom’s son asks court to throw out $3.5M lawsuit
The son of the late business tycoon Larry Hillblom has asked the Superior Court to throw out the $3.5 million lawsuit filed by one of the mothers of Hillblom’s children against the estate.
A complaint filed by Mercedes Feliciano accused Hillbloom of forcing her to engage in sexual intercourse when she was 15 years old, virtually turning her into a sexual slave. She gave birth to a daughter, Mercedita Feliciano, on Dec. 22, 1995.
In seeking $3 million in damages, Feliciano said she suffered humiliation, mental anguish and severe emotional distress. She is also seeking $500,000 in payment for attorney’s fees.
However, Junior Larry Hillbroom, through his counsels David J. Lujan and Joe Hill, joined the estate’s executor, Bank of Saipan, in seeking a summary dismissal of Feliciano’s complaint.
In fact, Junior Larry wants Ms. Feliciano’s lawyer Joseph Aldan Arriola to explain why he is demanding a $500,000 in attorneys fee. Ms. Feliciano’s lawyer is in “la-la-land” for believing that the estate will simply surrender the money, said Hillbroom.
Junior Larry noted that Feliciano’s lawyer apparently has no idea about “the ferociousness of the legal battles that have occurred in this estate. In asking the court to reject Ms. Feliciano’s complaint, Junior Larry said Ms. Feliciano’s counsel should be sent back to “la-la-land to dream up further fantasies or perhaps write a comic strip as a living.”
Earlier, Jack Londen, counsel for the executor, said Ms. Feliciano’s claim was untimely since it was not filed within the 60 days after the first notice to creditors was published. In this case, the 60-day period following the notice to creditors expired on Sept. 9, 1995.
Ms. Feliciano’s claim has been barred by the statute as it was also not submitted within 60 days after she reached 18. Since Ms. Feliciano has been involved in the estate proceedings since 1995, her notice of claim was only provided to the executor four years after.
