Superior Court Associate Judge Juan T. Lizama has set a $56,000 bail for the temporary release of Joseph Diaz Sablan, 27, who is facing charges of sexual abuse of a child.

Police arrested Mr. Diaz based on the complaint of the mother’s victim Esabelle Babauta about the alleged sexual abuse case involving her 15-year-old daughter.

Investigation conducted by Detective Mary-Louise Tanaka showed that SC.B.B. and her two friends were picked up by Mr. Sablan at the parking lot of the Movie Theater in San Jose at around 4:30 p.m. on Nov. 21, 2000.

The group later on went strolling around Dan Dan, Koblerville and San Antonio where they were made to smoke marijuana. Afterwards, the group went to the residence of Mr. Sablan in San Antonio at around 7:00 p.m. where they smoked marijuana again.

The two companions of the victim fell asleep after they smoked marijuana. At this time, Mr. Sablan took the victim to a room, removed her clothes and started kissing her.

She claimed she tried to stop the suspect and even struggled when he went on top of her but Mr. Sablan pinned her down and was able to rape her. The victim was later on brought to the Commonwealth Health Center for examination. (Lindablue F. Romero)
