Law firm sues former client over unpaid fees

A law firm yesterday sued its former client in a federal civil action over unpaid service fees amounting to over $77,000.

The O’Connor Berman Dotts & Banes filed with the Superior Court a suit against Mariana Fashions Inc., asking the court to award it monetary damages of at least $77,082.07 plus interests.

The law firm represented Mariana Fashions when the latter was sued by the U.S. Department of Labor in federal court.

Lawyer Robert O’Connor said that Mariana Fashions agreed to pay the law firm attorney’s fees and costs incidental to its legal representation of the company in the federal case.

O’Connor claimed that his law firm worked diligently on the case, expending “considerable time, work and energy” in representing Mariana Fashions.

He accused Mariana Fashions of breaching a binding contract with the law firm when the latter failed to pay attorney’s fees despite soliciting legal services. He also accused the defendant of unjust enrichment.

“[The] defendant received benefits from [the law firm] as a result of the legal representation and it would be unjust for defendant to retain such benefits without compensating [the law firm],” O’Connor said.
