A 37-year-old man was arrested Sunday night for allegedly assaulting another and stabbing him with a knife, according to the Department of Public Safety.

Police report said the suspect, Rudy S. Pangelinan, was taken into custody after investigation showed that he reportedly kicked and stabbed 34-year-old Redson R. Herwin at the stairway leading up to Diamond Karaoke Bar in San Jose.

The report indicated that a responding officer had asked Pangelinan of his involvement in the incident, which he allegedly denied. The officer reported that he saw blood dripping from Pangelinan’s face, prompting the questioning. His report showed that Pangelinan said the bleeding was a result of him falling down the stairs while walking.

“He then asked me to leave the area because he was fine and did not want police assistance,” he said in his report.

The officer was then informed by a security guard at the area that Pangelinan was involved in the incident.

Further investigation showed that the victim, who was found to be intoxicated, had just been in an argument with his common-law wife. As he was walking between Downtown Market and the Morgen Building, he reportedly screamed out his frustration, only to hear someone else scream back.

The victim walked toward the karaoke bar where he heard the scream come from and encountered a man, who was shouting profanities at him. The man was later identified as Pangelinan by the victim’s brother, 40-year-old Ylaycios R. Herwin, who had witnessed the incident.

Ylaycios said that Redson walked up the stairway and was allegedly kicked by Pangelinan. He said the victim fell and then ran back toward the suspect.

“He then saw the local male stab Redson’s back three times with a silver blade. He saw Redson execute a clothesline maneuver on the suspect,” the report stated.

The victim was taken to the Commonwealth Health Center for treatment.

The report said that the victim, suspect, and the victim’s brother were all intoxicated at the time of the incident. It also noted the victim as stating that he did not know the suspect before the incident.
