Woman convicted of homicide by vehicle, DUI

A woman was found guilty of homicide by vehicle and driving under the influence of alcohol.

In an amended judgment order dated Sept. 1, 2004, Superior Court associate judge David Wiseman declared Micheline West Brel guilty of the offenses as charged. Her sentencing is scheduled on Oct. 21, 2004.

The ruling came after the court accepted the defendant’s guilty plea. It did not provide further details of the case.

During a hearing on Aug. 31, the defendant’s legal counsel, assistant public defender Jennifer Ahnstedt, informed the court that her client would enter the guilty plea.

As a result, the government, represented by assistant attorney general Joseph Taijeron, moved to dismiss the other charges filed against Brel.

Wiseman said that the defendant was advised of her constitutional rights and the consequences of her plea. The defendant was further advised of the maximum possible penalty of the offense and any minimum penalty required.

Wiseman said the defendant waived her rights and entered a guilty plea to two charges: homicide by vehicle and DUI.

“The court accepted defendant’s plea…after finding that her decision…is freely, voluntary, and intelligently made; she has had the advise of a competent counsel whom she said she was satisfied with; she understood the consequences of her guilty plea; and there is a factual basis for the plea of guilty,” Wiseman said.
