Firm sues trader over unpaid fuel purchases

A company operating a Shell station on Saipan filed a lawsuit against a businessman over nonpayment of fuel purchases.

D & W Enterprises, Inc. lodged a complaint against Mariano M. Falig, who operates the Kosa Fisheries, at the Superior Court.

D & W’s lawyer, S. Joshua Berger, accused Falig of breaching its contract with his client. Beginning Dec. 2001 until Sept. 2003, Falig purchased diesel from D & W on several occasions, according to Berger.

Berger said unpaid purchases now amount to some $3,864.86. He asked the court to compel Falig to pay D & W the unpaid amount and to shoulder costs incidental to the lawsuit.
