Employer sanctioned for negligence

The Department of Labor Hearing Office recently sanctioned an employer who was found negligent in filing a late application for renewal for a nonresident worker.

Hearing officer Maya B. Kara ordered employer Nestor Ablog to pay $200 for failure to timely submit required documents for the renewal of Romeo C. Cayetano, who was employed by Ablog as an auto body repairman.

Cayetano’s work permit expired on July 26, 2004, but the employer did not file a renewal application until Sept. 2, or 38 days late, resulting in Labor denying the application.

In a hearing on Jan. 11, the employer admitted being at fault, saying he was off-island and was unable to attend to the renewal of the application.

The department was satisfied with the explanation, and recommended that that denial be reversed provided that the employer pay the fee no later than 10 days after the issuance of the order. The matter is remanded to the Processing Section to resume processing the application. (Shan Seman)
