Employer fined $500 for late filing

The Department of Labor Hearing Office recently sanctioned an employer for failure to complete applications for two nonresident workers.

Shortly after a recent hearing, Hearing Officer Maya B. Kara penalized Geotesting Inc. $500 for a four-month delay in submitting a copy of a Job Vacancy Waiver for both Hermogenes Beltran and Ray Diampoc.

Both employees had timely submitted their labor permit applications on Sept. 10, 2004. The applications were denied on Nov. 15, 2004 because the employer failed to comply with the Job Vacancy Announcement requirements.

At a Jan. 18 hearing, the employer, represented by Laura Tenorio, admitted to be at fault for failing to timely provide a JVA waiver, which Kara found to be irresponsible and negligent on the part of the employer.

Meanwhile, Kara ordered the applications for Beltran and Diampoc be remanded to the Processing Section for further processing provided the employer pays the fine within 10 days of the issuance of the order.

The order was dated Jan. 26, 2005.
