3 firms fined for deficiencies

The Department of Labor has fined three employers for failing to promptly submit all documents required for employment applications.

In three separate administrative orders, hearing officers Cinta Kaipat and Jerry Cody ordered a fine of $200 each against Triple M Corp., Multi Business Corp., and Oceans Inc.

Kaipat and Cody instructed the Processing Section to resume processing the companies’ applications when the sanctions are paid.

The three companies were fined because they failed to cure deficiencies in their submissions within the 10-day period given.

In the case of Triple M, the company filed a renewal application for worker Loid Quijom Feria without submitting the necessary job vacancy announcement. As a result, she was issued a deficiency notice instructing her to complete the requirements within 10 days.

At the hearing, Triple M general manager Maggie Taimanao admitted that she failed to comply within the notice because she left the Commonwealth 10 days after the application was filed. No one in her company knew how to take care of the application properly.

The JVA submitted by Multi Business along with the employment application expired before the processing was completed.

The company was also given 10 days to cure the deficiency, but failed to do so within the given time. However, Multi Business later produced the document at the hearing.

For its part, Oceans Inc. failed to promptly submit the two missing documents in its application: a certified VA and a business establishment inspection.

At the hearing, the general manager testified he had been served with the deficiency notice on the day of filing. He handed the matter to the company president, who passed it to the company’s processing agent. The agent failed to correct the deficiencies and has since left the Commonwealth.

The general manager also expressed remorse and asked for additional time to enable the company to comply with the deficiencies.

Oceans Inc. was given until July 13, 2005 to correct the deficiencies.
