Court reaffirms bail terms

Presiding Judge Edward Manibusan yesterday denied the request of three non-resident workers to modify the conditions of their bail but granted one temporarily.

Xiao Hui Lin, Yang Yang, Jian Qing Zheng and Yu Ping Guo were arrested in a prostitution bust conducted by officers of the Department of Public Safety in Garapan two weeks ago.

Assistant Attorney General Marvin J. Williams charged each of them with one count of prostitution loitering.

Court documents showed that Lin, Yang, Zheng and Guo were observed in a prostitution prone location for approximately 45 minutes and repeatedly beckoned, stopped and attempted to stop or engaged male passersby in conversation for the purpose of prostitution.

The court, in a bail hearing held last Dec. 9, ordered that they post $500 cash bail, stay away from all ports, surrender travel documents and to observe daily curfew from 7 p.m. to 6 a.m.

Defense counsel William Campbell said all the conditions of their release were reasonably and rationally justified, related to ensuring that they do not flee jurisdiction and cooperate in the process of justice, except for the curfew.

Campbell said the defendants are employed in the Garapan area on evening shift when most tourists shop, go to restaurants, souvenir shops or night clubs.

Such curfew hours may be appropriate for daytime office and service workers but not for the defendants who are employed in the evening hours.

In yesterday’s proceedings, employment contracts of the defendants were submitted to court showing that Zheng’s contract requires him to work from 8 p.m. to 2 a.m. while Yang’s work hours are from 7 p.m. to 2 a.m.

After hearing arguments of both counsels, Manibusan denied the request of Yang, Zheng and Liu. However, the court granted Guo’s request temporarily which ends today due to her Temporary Work Authorization which expires today.
