Camacho’s trial to go on as scheduled
Supreme Court Associate Justice Alexandro C. Castro had denied the motion to stay the jury trial of Jesse James Camacho and ordered the Superior Court proceedings to go on as scheduled.
Camacho is charged with one count of murder in the first degree (criminal case) and one count each of solicitation and conspiracy (juvenile case).
Last December 10, 1998, the Superior Court issued an order that called for the transfer of the juvenile charges for prosecution as an adult.
The defendant appealed the order to the Supreme Court citing rule 27 to stop the trial. It raised the question on whether the Superior Court has jurisdiction to consolidate the criminal and juvenile cases.
According to the Supreme Court ruling, the lower court did not abuse its discretion in denying the earlier motion and agreed with the lower court’s decision to move forward with the trial on a more substantial murder charge.
Camacho, who is still under 18, was arrested in May last year and has been incarcerated since then. He was transferred to the Department of Correction last December 10, 1998.
