Man hit in car accident sues driver

A man who was seriously injured after being hit by a vehicle while rolling on his wheelchair along Beach Road has sued the vehicle’s driver and the driver’s employer.

Neil Martin Goldman filed the civil action suit at the US District Court on Oct. 5. He is demanding a jury trial.

Named defendants were Jae Bong Choi, driver of the Hyundai Starex Bus that hit Goldman; and the driver’s employer, Saipan Hyunjin Saipan Inc., the registered owner of the vehicle.

The case stemmed from a road accident on the night of Sept. 8. Jae was driving northbound along Beach Road, Garapan when he hit Goldman who was rolling a motorized wheelchair, trying to cross the road in front of Gold Beach Hotel.

Goldman was thrown to the ground “with great force and violence, thereby causing him extensive internal and external injuries great pain, soreness, and severe serious shock,” according to the complaint filed by Goldman’s attorney Eric Smith said.

Smith stated in the complaint that the injuries suffered by Goldman “were directly and proximately caused by the carelessness and negligence of defendants Jae and Hyunjin through their failure to exercise the proper degree of case.”

Jae, the complaint said, was driving at a speed “in excess of the allowable rate of speed in that area.”

Smith said the collision could have been avoided had Jae been careful, considering that he saw Goldman in “perilous position.”

The complaint also faulted Hyunjin for allowing Jae to operate a company without a driver’s license.

Goldman is seeking judgment against the defendants for past and future medical expenses, for mental anguish and physical sufferings, and for other damages in an amount to be determined at the trial. (MCM)
