Theft suspect not competent to stand trial
Superior Court Associate Judge Juan T. Lizama has ruled that theft and burglary suspect Lucas T. Manglona is not competent to stand trial after an evaluation was conducted by Division of Corrections forensic psychiatrist Dr. Laura Post and Dr. Anthony Bottone of the Commonwealth Health Center.
Mr. Manglona, 23, was charged along with two others before the Superior Court in connection with theft and burglary incident on Dec. 6, 1999 in Susupe.
Judge Lizama said Mr. Manglona will remain in the custody of DOC since the hospital lacks adequate facilities to treat the suspect.
In the meantime, since there is a possibility that the defendant will not regain competency within 90 days, the judge ordered Mr. Manglona to submit to a laboratory and physical examination required by Dr. Bottone, which include drug and alcohol testing. He shall be assisted by Dr. Post in the re-evaluation of the suspect’s competency to stand trial which shall be conducted after 12 weeks of outpatient treatment.
Dr. Post shall submit a second psychiatric competency evaluation to the court on or before July 15, 2000. A second competency hearing has been set on Aug. 9, 2000.
