Court okays summary judgment against Wendy's
Superior Court Presiding Judge Edward Manibusan has granted the motion for summary judgment of Niizeki International Saipan. Co. against Wendy’s Saipan International.
The international fastfood chain ceased operating on Saipan in October 2000 due to the slowdown in the island’s economy, which has resulted in financial losses for the company.
Court records show that WSI has not been able to pay its rental obligation which has ballooned to $58,103.
As early as Oct. 26, 1999, Niizeki has issued a notice of default to Wendy’s for nonpayment of rent on the property located on Beach Road in Garapan.
On Nov. 30, 1999, Wendy’s paid $9,729 to Niizeki which was credited to past due rent. Wendy’s again paid on Dec. 31, 1999 $14,729 to Niizeki and credited to past due rent.
Wendy’s and other establishments on the island have been severely affected since the onslaught of the regional crisis in 1997. As a result, the restaurant was forced to take cuts in operating expenses as it shortened store hours and eliminated breakfast menus.
The popular international chain has 365 restaurants throughout the world, excluding 4,964 in the mainland United States, 300 in Canada and about 1,866 Tim Horton’s restaurants.
