NMIRF sues ex-DPH exec over $156K debt

The Northern Mariana Islands Retirement Fund yesterday filed a lawsuit against former Deputy Public Health Secretary Ned S. Arriola to collect on debts amounting to over $156,000.

The Retirement Fund also named Arriola’s wife, Kathleen, as co-defendant in the civil action it filed with the Superior Court.

The Fund’s lawyer, Michael White, alleged that the Arriolas defaulted on the obligation for not making any payment to the government corporation.

White said the Arriolas executed a promissory note in favor of the Fund on Oct. 28, 1993, which they secured by mortgaging an 886-sqm real property on Saipan.

Currently, White said the Arriolas owe the Fund at least $156,100.71, exclusive of interests and late charges that have reached close to $2,000.

The Fund sent a notice of default to the Arriolas last May 25, but White said the defendants refused to settle the debt despite demand.

The Fund asked the court to compel the Arriolas to pay the Fund the owed amount. It sought the foreclosure of the mortgaged land, so it could be auctioned to pay for the debt that could be awarded by the court to the government corporation.

Arriola refused to comment on the lawsuit, referring the Saipan Tribune to his lawyer, Perry Inos, who could not be reached as of press time.
