Labor office affirms denial of permit application
The Department of Labor Hearing Office recently affirmed the decision by the administration to deny the permit expiration transfer application of a nonresident worker.
Hearing officer Jerry Cody ruled that the denial by the administration was supported during a hearing, with facts indicating that the application was denied because it lacked authorization from the employer’s president.
Labor documents show that Zhang Si Qing was to be hired by American Lengente Corp. as a general manager, with authorization from the corporation’s vice president, Zhang Mei.
The application was denied because a week before the employment contract was submitted to Labor, the president of the corporation, Tang Langen, advised Labor not to honor any company contracts without his signature.
Langen decided this after assuming direct control of the management of the business because of the company’s alleged nonpayment of more than $50,000 in wages to its former employees, which resulted in an investigation by the U.S. Department of Labor Wage and Hour Division.
The company currently does not have any employees and Tang confirmed that there are no plans to hire any workers until all the wages are paid. With that, there was no need for a general manager.
Cody also granted Zhang Si Qing transfer relief, giving him 45 days to transfer to another employer. Zhang would be deported if the transfer is not done within the time given.
