Two persons sue over vehicular accident
Two persons sued another man yesterday over a vehicular accident that resulted in their being injured.
In a complaint filed with the U.S. District Court, Douglas G. Chanco and Evangeline P. Uson claimed monetary damages against one Roy E. Tarope, saying their injuries have yet to fully heal.
David Banes, Chanco and Uson’s attorney, said his clients also lost wages and future earnings.
The complaint said that Chanco was driving a moped with Uson on the northbound lane of Beach Road, San Jose on Oct. 29, 2004, when Tarope’s silver Mitsubishi with license plate ACE-603 allegedly entered the highway to make a left turn at the intersection by the Downtown Market.
“Mr. Chanco applied the brakes, but because of the proximity of the car, was unable to stop, hitting the other vehicle. This caused the moped that the plaintiffs were driving to fall over, slide down the street and spin around once,” Banes said.
Chanco and Uson were rushed to the Commonwealth Health Center.
Banes accused Tarope of reckless disregard for the safety of other motorists, including Chanco and Uson, who were driving the moped with due care.
