Cepeda pleads not guilty to indictment
The U.S. Attorney’s Office has indicted Tinian Police Sergeant Peter B. Cepeda, who was arrested Tuesday for allegedly selling methamphetamine or “ice.” He pleaded not guilty.
Cepeda, 44, was indicted on one count of distribution of a controlled substance. He posted a 929-square meter lot as property bond for his temporary release.
Attorney Danilo Aguilar, counsel for the defendant, told the federal court that on Wednesday afternoon his client had surrendered his 9mm semiautomatic service firearm and ammunition to Tinian Department of Public Safety armorer Sgt. Elloy K. Fitial.
U.S. District Court Chief Judge Alex R. Munson set the jury trial for May 22, 2006 at 9am.
Munson said pretrial motions shall be filed on later than April 12, 2006.
The judge allowed the release of Cepeda on $10,000 cash or property bond.
Among the conditions of the release is that the police sergeant will be placed on 24-hour home incarceration.
According to a Drug Enforcement Administration special agent in court papers, the defendant sold $200 worth of “ice” to a DEA cooperating source during a controlled purchase on Tinian on Oct. 25, 2005.
On Oct. 24, 2005, the Superior Court convicted Cepeda of two counts of assault and battery for assaulting a police officer and a woman on Tinian.
Associate Judge David A. Wiseman sentenced Cepeda to one year of supervised probation for two counts of assault and battery.
