Construction company sues another firm over airport project
A construction company has sued another construction company over their dispute regarding subcontract services related to a project at the Saipan International Airport.
EQ Construction sued ASC Architecture and Structure Corp. that owns ASC Construction, for breach of subcontract agreement.
EQ Construction, through counsel Danilo Aguilar, stated in the complaint that as of Dec. 4, 2003, ASC Construction has an outstanding balance on the subcontract agreement in the amount of $11,367.
The plaintiff asked the Superior Court to order ASC Construction to pay the outstanding balance, attorney’s fee, and court costs.
Aguilar said that on Sept. 20, 2001, EQ and ASC entered into an agreement.
Under the agreement, EQ will provide construction services to defendant in connection with the implementation of defendant’s project known as the “Saipan International Airport roof fascia and airport signage.”
The agreement provided that in return, defendant would pay EQ a lump sum of$60,000 services, 10 percent of which will be initially paid for mobilization 80 percent during the construction period, and the final 10 percent after completion of the project.
Aguilar said that from the period Oct. 22, 2001, through Oct. 28, 2003, his client provided and has fully performed all services required by the defendant.
For the same period of time, defendant has made some payments, he said.
On Dec. 4, 2003, plaintiff sent a final billing for the balance due in the amount of $11,367.36.
“Despite repeated follow-up by phone, no payment was made by defendant,” the lawyer said. (Ferdie de la Torre)
