Tractor operator in head-on collision sues
A Public Works heavy equipment operator has sued a motorist for the injuries he sustained as a result of a head-on collision between a tractor and a car.
Ramon Ramos Deleon Guerrero sued Joshua Charles Gibson for negligence.
Deleon Guerrero, through counsel Victorino DLG. Torres, asked the Superior Court to order Gibson to pay him damages, attorney’s fees, and court costs.
Torres stated in the complaint that on July 20, 2006, Deleon Guerrero was operating a tractor to mow the shoulder of Highway 16 in Papago as part of his duties for DPW.
The plaintiff saw a white car, which was driven by Gibson, traveling south toward him.
Torres said his client stopped the tractor to prevent rocks and other debris from flying into the oncoming vehicle.
The lawyer said that Gibson suddenly and unexpectedly swerved off his lane, causing a head-on collision with the tractor.
“Upon collision, Mr. Deleon Guerrero was immediately ejected from his seat on the tractor, violently hurled into mid-air and brutally landed on the asphalt road where Mr. Deleon Guerrero sustained serious personal injuries,” Torres said.
He said that, because of Gibson’s reckless, careless and negligent failure to drive in a reasonable manner, defendant collided into plaintiff’s tractor “causing severe personal injuries to Mr. Deleon Guerrero.”
