Injured passenger in CK smashup files suit

A passenger of a car who was injured in a vehicular accident in Chalan Kanoa has sued the driver of the other vehicle.

Yue Fang Xie Demapan, through lawyer Victorino DLG. Torres, sued Crispin Daque Beltran for negligence.

Demapan asked the Superior Court to order Beltran to pay her damages, court costs, and attorney’s fees.

Torres stated in the complaint that on Feb. 17, 2008, Demapan was a rear passenger of a sedan that was traveling north on Beach Road in Chalan Kanoa. Beltran was driving south on Beach Road.

The lawyer said that Beltran failed to stop or yield to oncoming traffic, causing his vehicle to collide with the sedan.

“As a direct and proximate result of Beltran’s negligence and recklessness, Mrs. Demapan’s face smashed into the seat in front of her causing her severe pain and injuries,” he said.

Torres asserted that the defendant breached his duties when he entered the oncoming traffic without first stopping at the posted stop sign.
