A Tinian landowner has sued an investor over alleged non-payment of rental in the amount of $490,447.

Jose P. San Nicolas asked the Superior Court to order Jung Eun Teack to pay him back rent plus damages, court costs and attorney’s fees.

San Nicolas, through counsel Joey P. San Nicolas, asked the court to forfeit the lease agreement and restored his rights to the property.

Atty. San Nicolas stated in the complaint that on Sept. 2, 1999, the parties entered into a written lease agreement concerning plaintiff’s 997 square meters of land in San Jose, Tinian.

Atty. San Nicolas said Teack has failed to pay the rental amount due since February 2005.

He said despite plaintiff’s demands for payment, the defendant “has failed, refused, and still fails and refuses, to perform his obligations under the lease agreement.”
