Pedestrian struck at crosswalk sues
A pedestrian has sued a motorist over the serious injuries she suffered when a vehicle struck her at a pedestrian crosswalk along Middle Road in Gualo Rai last year.
Xi Feng Jiang sued Emtaaz Ahmed Chowdhury for negligence.
Jiang asked the Superior Court to order Chowdhury to pay her damages.
Attorney William M. Fitzgerald, lawyer for Jiang, stated in the complaint that on Nov. 19, 2007, at 1pm, Jiang was crossing Middle Road within a plainly marked designated pedestrian crosswalk.
Fitzgerald said Chowdhury was operating his vehicle at an excessive rate of speed while approaching a pedestrian crosswalk.
The lawyer said the defendant “negligently, recklessly, and carelessly” operated his vehicle, hitting Jiang as she was crossing the road near the Gualo Rai Building, knocking her to the ground.
“As a direct and proximate result of the defendant’s said carelessness, recklessness and negligence, plaintiff sustained serious and permanent injuries and has suffered and will continue to suffer great pain of body, mind and emotional distress, including, multiple bruises and lacerations, and a fracture of her right tibia and fibula, which required surgery,” Fitzgerald said.
