Three-year prison term for ex-senator’s son
Superior Court Associate Judge Kenneth Govendo has imposed a three-year prison sentence on a man who sexually abused a minor.
Govendo gave Pasqual K. Deleon Guerrero credit for two days he had already served in jail.
“The court believes this is a case where the interests of justice and of this society will be best served by imposing a jail term that the court believes will have a deterrent effect on the defendant upon his release, upon any potential offenders, and will serve the retribution that society demands,” said Govendo in a written order issued Thursday.
Deleon Guerrero, 23, entered guilty to one count of sexual abuse of a minor in the second degree.
Govendo said the message must go out to the community that young men, aged 18 and older, will face severe punishment if they engage in sexual relations with a minor.
“The loose morals that allow this society to turn a blind eye on this practice must be challenged and changed,” he said.
The judge said he is adamant in his belief that the best way to implement this change is for parents to take responsibility for educating their young boys and girls as to what is proper sexual conduct and what is not.
Deleon Guerrero was allowed to continue his narcolepsy treatment.
“If the treatments must take place outside of the Department of Corrections then the DOC shall provide transportation,” Govendo said.
The judge also allowed the defendant access to any psychiatric and or psychological treatments arranged by his family for the treatment of his suffering from past sexual abuse.
DOC, Govendo said, shall provide a private room for these treatments and Deleon Guerrero shall be given all the time necessary for these treatments.
Govendo acknowledged that the defendant may be paroled after one year of imprisonment if he maintains a record of good behavior.
In 2007, the Attorney General’s Office charged the defendant with one count of sexual abuse of a minor in the first degree and one count of sexual abuse of a minor in the second degree.
The defendant and counsel signed a plea agreement with the government.
The agreement stated that on or between June 1, 2006, and Aug. 2, 2006, Deleon Guerrero, being 20 then, engaged in sexual contact with a girl who was then 11 years old.
The girl reportedly confessed to her parents about their sexual contact when they confronted her after she and the defendant were seen watching a movie together.
Deleon Guerrero is the son of former senator Ramon Deleon Guerrero.
