Man in domestic violence gets probation
The Superior Court yesterday handed down a six-month probation sentence on a man who assaulted his wife at a Susupe park during an argument.
Associate Judge David Wiseman sentenced Adrian Baculod to six months in prison, all suspended, for assault.
Following a plea agreement, Wiseman placed Baculod on six months probation and required him to perform 30 hours of community service.
The judge ordered the defendant to write a letter of apology to the victim and pay a $200 fine, $25 court assessment fee plus probation fee.
Wiseman directed Baculod to seek appointment with the Community Guidance Center for counseling.
Baculod was charged with assault and battery. He signed a plea agreement with the government and pleaded guilty to the lesser offense of assault.
The assault incident occurred on April 20, 2008. Police said the wife sustained a laceration to the face.
Detective Andrea C. Ozawa stated in her report that on April 20 at 1:15am, while two police officers were on routine patrol, they spotted a vehicle parked at the Susupe Regional Park with its park lights on.
As the police officers were approaching the entrance to the park to check, the vehicle headed toward the marked police vehicle.
The driver’s window was rolled down and the driver, later identified as Baculod, told officers he was having an argument with his wife.
The officers then heard a woman inside the car yelling for help. The officers instructed Baculod to park the car. Baculod, however, drove out of the park, promptingd the officers to chase the car.
The car stopped near the Mobil service station in Susupe. When one of the two police officers approached the passenger side, a woman with blood all over her face opened the window and told the officer that her husband beat her up.
