Man sentenced to 20 days in prison for assault and battery

A 40-year old man who was found guilty of assault and battery, mischief, and disturbing the peace arising from an incident that happened almost two years ago will spend 20 days in prison, pay a $300 fine and do community service.

In a four-page order issued Wednesday, Associate Judge David A. Wiseman said that for the two counts of assault and battery, Donald Kileleman be imprisoned for a period of one year on each count, all suspended, except for 20 days to serve on each count and probation to serve for two years on both counts.

The sentences will run concurrently, which means they will be served at the same time.

The order also stated that Kileleman will pay $100 on each count of assault and battery and a fine of $50 for criminal mischief. Kileleman was also sentenced to six months for disturbing peace but this was suspended.

However, the sentence is subject to several terms and conditions, including two years on probation.

Kileleman was ordered to stay away and told not to make altercations with the victim and her family for the duration of his probation period unless some form of mediation process is conducted to reconcile the defendant with the victim and her family.

Court information stated that the defendant struck, beat or wounded and punched several times a neighbors and close relatives Adoracion Kileleman Hix , his aunt, and Nola Kileleman Hix, his cousin, during the incident.

The defendant also threatened Mrs. Hix with a flower vase.

For the third condition, the defendant should report to the Community Guidance Center for an initial evaluation and undergo anger management counseling.

He should also perform 75 hours of community work service at a minimum rate of 10 hours per month, refrain from possession and consumption of alcohol beverages for the duration of his probation, and pay restitution to the victim for property damages and medical bills incurred by the victim.
