Supplier sues Plumeria for allegedly refusing to pay for gas
A fuel supplier has sued the management company and owners or agents of Plumeria Resort in Achugao for allegedly refusing to pay $28,064 worth of diesel fuel delivery.
AA Enterprises Inc. sued Noah Saipan Inc. and 10 unnamed owners or agents of Plumeria Resort for breach of contract.
AA Enterprises, through lawyer Robert T. Torres, asked the Superior Court to order the defendants to pay the sum plus accrued interest, court costs, and attorney’s fees.
Torres stated in the complaint that Noah Saipan Inc. was retained by the Saipan Achugao Resort Member Association, SARMA, to manage the Plumeria Resort.
Torres said Noah was fully authorized to contract on behalf of Plumeria Resort and SARMA for supplies and fuel.
The lawyer said the defendants, as purchaser itself and or the manager for the resort, ordered diesel fuel from AA Enterprises.
Torres said the defendants agreed to pay for the fuel and interest at the rate of 1 percent per month on all accounts remaining unpaid after 30 days from the date of the invoice.
He said that last Oct. 27, AA forwarded to Noah or Sarma a statement of its account reflecting the outstanding balance and the documentation upon which the charges were based.
“After examination, Noah Saipan and SARMA acknowledged the charges and expressed its intention or desire to pay them,” Torres said.
