The Superior Court has ordered an alleged overstaying alien worker on Rota who moved to Saipan to appear in court this Thursday for a deportation hearing.

Associate Judge David A. Wiseman directed Elvis B. Tibong to explain in court why he should not be deported from the CNMI.

Wiseman issued the order to show cause after the Division of Immigration filed a deportation case against the 31-year-old Tibong.

According to court documents, Tibong, a Filipino, used to work as a farmer, then became a mason.

Immigration investigator John Peter stated in his report that Tibong’s nonresident worker’s entry permit expired on April 17, 2007.

Peter said Tibong has overstayed in the CNMI for over one year now.

Peter said Tibong’s employer from Rota called him last November to inform him that the worker wanted to move to Saipan for look for a new employer.

The investigator said the employer expressed concern because the worker may have lied and was hiding on Saipan with his girlfriend.

Apparently, the girlfriend is also an alleged overstayer.
