Jobless worker who damaged two cars gets 53-day sentence
Superior Court Associate Judge David A. Wiseman has imposed a 53-day prison term on one of two jobless alien workers accused of burglarizing two parked cars and stealing battery and airbags from the vehicles.
For two counts of criminal mischief, Wiseman sentenced Xi Wen Li to 53 days in jail but gave him credit for the 23 days he had already served in prison.
After his release from the Department of Corrections on May 8, Li, a Chinese national, shall be released to the CNMI Immigration for deportation, Wiseman said.
The judge noted that the defendant consented to deportation.
Li was required to pay a $25 court assessment fee.
The Attorney General’s Office charged Li and co-defendant Ying Xiang Cao with theft, attempted theft, and two counts of criminal mischief.
Li signed a plea agreement. He pleaded guilty to two counts of criminal mischief. The court dismissed the remaining charges pursuant to the agreement.
The agreement stated that on Sept. 26, 2008, Li damaged to Rong Bai Li’s Toyota Corolla in the rear, passenger side window.
Detective Abraham C. Villagomez stated in his report that a caller reported to the Department of Public Safety last Sept. 26 that a burglary and theft incident happened at the former Joeten Shopping Center in Chalan Kanoa.
Police responded and arrested the two defendants. Police said the two admitted breaking into the two vehicles and stealing airbags and battery from one car.
The two allegedly confessed planning to sell the battery and airbags to an auto shop to make money because they are jobless.
