Two landowners sue Jin Apparel, officer

Two landowners sued the defunct Jin Apparel Inc. and its officer for allegedly failing to pay the lease agreement to their property.

Daniel T. Villagomez and Rosario DLG. Villagomez sued Jin Apparel and Hun Soo Park for breach of contract.

The plaintiffs, through counsel Judy DLG. Torres, asked the Superior Court to order the defendants to pay them damages, court costs, and attorney’s fees.

The Villagomez plaintiffs and the defendants executed a ground lease agreement on April 2, 1987. Pursuant to the amended lease agreement, Jin Apparel and Park agreed to pay plaintiffs every month $2,000, increasing by 5 percent every five years from the date the instrument was executed.

Torres said the defendants failed to make any payments from January to March in 2009. On March 5, 2009, Torres said his clients notified the defendants in writing of their default and breach of the lease agreement.

In October 2007, Jin Apparel filed a notice to the Department of Labor about its plan to suspend business operations from Dec. 31, 2007, until March 31, 2008.
