2 men get jail time for disturbance

Superior Court Presiding Judge Robert C. Naraja has imposed prison terms on two men who both pleaded guilty to disturbing the peace in separate cases.

Naraja on Tuesday slapped Joaquin Adriano Jr. with six months imprisonment, all suspended except for four days, and imposed a sentence of six months in prison, all suspended except for four months and seven days on Martino Martin Omelau.

Adriano and Omelau were released that day as they were given credit for time served. Adriano already served four days in jail. Omelau spent four months and seven days in jail since his arrest.

Adriano, 31, was placed on probation for one year, while Omelau, 35, was placed on probation for six months.

In addition, Adriano was ordered to perform 150 hours of community service and pay a $350 fine, $25 court fee, and $100 probation fee. He was required to complete anger management counseling.

Omelau was ordered to pay a $100 fine, $25 court fee, and $60 probation fee. He is prohibited from consuming any alcoholic beverages during his probation.

The amended information charged Adriano with disturbing the peace (domestic violence). Omelau was charged with assault and battery, and disturbing the peace. The two signed plea agreements with the government and pleaded guilty to disturbing the peace.

According to the plea deal, on Aug. 1, 2013 on Saipan, Adriano was involved in a verbal altercation with his girlfriend in the presence of their minor children. Adriano’s actions disturbed his girlfriend’s peace.

In Omelau’s case, the plea agreement states that on Aug. 16, 2013, on Saipan, the defendant, who was intoxicated at the time, disturbed the peace of his brother-in-law by shouting profanities at him at a family gathering.

Police said that Omelau hit his brother-in-law in the eye with a rock during a drinking session at a house in Chalan Kanoa. The victim sustained a two-inch laceration in the upper left eye and was taken to the hospital.
