Judge issues show-cause order against Ramsey
A physician is being asked to explain why his wrongful termination lawsuit against the CNMI government should not be dismissed.
If the lawsuit is dismissed, Dr. Gary Ramsey should explain why the dismissal should not be with prejudice, said U.S. District Court for the NMI designated judge Frances Tydingco-Gatewood last Friday.
Dismissal with prejudice means the doctor can no longer re-file the case.
Tydingco-Gatewood said that last Sept. 27, she ordered Ramsey to file an amended complaint by Oct. 11, 2017, or the case would be dismissed.
The judge said Oct. 11 has passed and a review of the docket shows that no amended complaint or motion to extend time has been filed.
Last Oct. 12, the CNMI government, the Commonwealth Healthcare Corp., and other defendants filed a motion to dismiss the case for failure to comply with the court’s order.
Defendants Jeanolivia Grant and CHCC chief executive officer Esther Muña joined in the motion to dismiss.
Ramsey alleges in his lawsuit that the Commonwealth and the public corporation that runs the Commonwealth Health Center wrongfully denied him privileges at the hospital.
Ramsey named as defendants in his lawsuit the CNMI government, CHCC, Muña and several other present and former hospital officials.
On May 29, 2015, the court dismissed the CNMI government and CHCC from the four claims in Ramsey’s lawsuit.
