Manglona issues show-cause order against woman suing DPL, ex-secretary Pete A.

The federal court has ordered a woman who sued the Department of Public Lands and its then-secretary Pedro A. Tenorio over grazing permit matter in 2015, to explain why the lawsuit should not be dismissed.

In an order to show cause issued on Monday, U.S. District Court for the NMI Chief Judge Ramona V. Manglona said no proof of service of the lawsuit on any defendants DPL and Tenorio has been made.

Manglona said no waiver of service has been filed.

The judge said if within 14 days from Monday plaintiff Congxiang Su Palacios has not shown cause, the matter will be dismissed without prejudice.

Dismiss without prejudice allows Palacios to re-file the case in the future.

Palacios, through counsel Braddock J. Huesman, sued DPL and Tenorio for breach of contract for allegedly cancelling her temporary agricultural and grazing permit because the “big boss” needed his land back. She is suing Tenorio for violation of her due process and equal protection.

Palacios demanded payment for damages.
