Probable cause found to charge man in domestic violence case
Superior Court Associate Judge David A. Wiseman found probable cause yesterday to warrant the filing of charges against a man who allegedly pushed his girlfriend and poked her face with his finger when he found her outside their house talking to their neighbor in Dandan.
At a preliminary hearing, Wiseman found probable cause to believe that the crimes of assault and battery and disturbing the peace may have been committed and that Michael Lee Borja may have committed the offenses.
Wiseman ordered the 35-year-old Borja to answer the charges.
Arraignment will be on Sept. 29, which is the defendant’s birthday.
Police detective Flora Aguon testified for the government at the hearing.
Chief Prosecutor Brian Flaherty appeared for the government.
Wiseman learned that Borja has had several previous temporary restraining orders for alleged domestic violence from his past relationship with girlfriends.
Aguon stated in her report that a police officer was dispatched last Sept. 17 at 2:52am to a residence in Dandan where a domestic violence was reported.
The girlfriend alleged that Borja pushed her twice, causing her to fall to the floor. He allegedly repeatedly asked her what she was doing outside the house and then poked her face with his finger.
