AGO seeks dismissal of case vs teacher
The Attorney General’s Office yesterday asked the Superior Court to dismiss the criminal charges against a teacher who allegedly assaulted a 15-year-old student.
James C. Burgess, 55, wants to leave the islands and vowed to never return again, according to CNMI chief prosecutor David Hutton.
Burgess, a teacher at the Kagman High School, allegedly fought with a student after a heated altercation last Feb. 9 Hutton then charged Burgess with two counts of assault and a count of disturbing the peace.
Hutton asked the court to dismiss the charges without prejudice to possibly refilling them again.
Should Burgess eventually return to the CNMI, Hutton said the AGO would reinstate the criminal charges against the teacher.
