The Department of Labor and Immigration yesterday sued the owners of a night club in Garapan for failure to enforce a long-standing administrative order for the settlement of their unpaid obligations to 10 nonresident workers.
The labor department filed the civil case at the Superior Court against Yoo Gab Jun, Park Kil Ja and Yoo He, Soo, owners of Top 40 club for violation of the Nonresident Workers Act and DOLI’s administrative order.
The case was filed on behalf of the club’s former waitresses, who were owed a total of $36,941 in unpaid overtime wages, liquidates damages, civil fines and unreimbursed illegal deductions, among others.
The employees, all of the Philippines, had complained that they were made to work beyond 40 hours a week without receiving the corresponding overtime pay.
DOLI’s Hearing Officer Herbert Soll issued the administrative order in April 1996.
In April of this year, Labor Director Gil San Nicolas reminded the club owners of their obligations, but they did not respond accordingly. (MCM)

owner appeals conviction
The owner of a construction company charged with hiring of illegal workers has appealed his criminal conviction for which he was sentenced to five years imprisonment.
Hyon Ok Lee, owner of Tower Construction Corp., filed the notice of appeal in the Supreme Court Tuesday.
Lee and his company were charged with 16 counts of “providing unlawful employment” to illegal workers, and were acquitted of four counts.
His hiring of illegal workers was discovered during a raid conducted last year by labor and immigration agents at the construction site.
Superior Court Associate Judge Juan T. Lizama, in an order issued June 28, sentenced Lee to five years of imprisonment all suspended. He was placed on probation for five years under the supervision of the Office of Probation.
Lee and his company were also ordered to pay a fine of $60,000. Of this amount, $5,000 is convertible to community work service.
Lee was ordered to pay the fine in monthly installment of not less than $300. (MCM)
