Over $200K default judgment issued vs. IPI

The U.S. District Court for the NMI has issued an over $200,000 default judgment in favor of Kan Pacific Saipan Ltd. against Imperial Pacific International (CNMI) LLC.

In Kan Pacific’s ongoing nonpayment suit against IPI, magistrate judge and clerk of court Heather Kennedy issued the default judgment after IPI failed to appear and plead its case before the court.

“Because IPI failed to appear, plead, or otherwise defend in this action, a clerk’s entry of default was entered pursuant to Federal Rule of Civil Procedure 55(a). Subsequently, Kan Pacific Saipan requested default judgment against IPI and filed a proper motion and affidavit in accordance with Federal Rule of Civil Procedure 55(b). Pursuant to Rule 55(b)(1), default judgment is hereby entered in favor of Kan Pacific Saipan and against defendant IPI,” states the order.

According to Kennedy, Kan Pacific is awarded the principal amount of $200,000, prejudgment interest of $9,698.63 which is the principal amount multiplied by 10% for each day of nonpayment as of Nov. 21, 2023.

In addition, Kan Pacific was granted legal fees and costs in the amount to be determined by the court following a motion from the plaintiff and post-judgment interest under the applicable federal post-judgment interest rate.

According to the lawsuit, IPI failed to pay Kan Pacific the annual payment due on June 1, 2023, in the amount of $200,000, and the default continued after Kan Pacific gave IPI its 10-day notice of default pursuant to the agreement.
