Court drops charge vs 1 of 4 rape suspects

The Superior Court has ordered the dismissal of the charge against Christopher Saimon, one of four men who allegedly raped a woman.

Superior Court Associate Judge Theresa Kim-Tenorio absolved Saimon, 38, Tuesday of the sexual assault in the second-degree charge against him.

The court order stating the court’s reasons for dismissing the charge has yet to be released.

During the hearing on Tuesday, Saimon’s lawyer, Oliver Manglona, moved for the court to relieve him of his duties as counsel to Saimon and to relieve Saimon’s mother of her duties as his third-party custodian.

According to Saipan Tribune archives, Saimon allegedly raped a drunk woman back in 2018, along with his brothers, Romeo and Joseph Saimon, and his nephew Richmond Keybond.

In a report by police detective Wally Emul Jr., the alleged victim reported that she was drinking with Romeo Saimon, Christopher Saimon, and Keybond last June 24, 2018, because she had an argument with her former boyfriend, Joseph Saimon.

Emul said the victim reported that she was drunk and that the next thing she remembers was she was in the bedroom and Romeo Saimon was on top of her.

She said she passed out and later saw Keybond on top of her. She said she also saw Christopher Aquino on top of her and that she passed out. Romeo Saimon and Keybond allegedly sexually assaulted her twice.

She told police that she did not consent to have sex with the three suspects.

Emul said Christopher Saimon stated that he saw both Romeo Saimon and Keybond enter the room where the alleged victim was sleeping.

Christopher Saimon said he peeked into the room and saw Romeo Saimon on top of her and later also saw Keybond having sex with her.

Christopher Saimon said Keybond told him to have sex with her. Christopher Saimon admitted he too had sex with the complainant.

Christopher Saimon said Romeo Saimon and Keybond went back to the room and had sex with the complainant again.

Christopher Saimon said when Joseph Saimon returned to the house, he saw his girlfriend naked in the room and punched Keybond.
