Radich insists on being allowed to have handgun

David J. Radich, a U.S. Navy veteran who, along with his wife, challenged the constitutionality of the CNMI’s handgun prohibition law, says he continues to be extremely concerned about self-defense for his wife and himself.

In his declaration filed in federal court, Radich described how an unidentified man invaded his home and attacked his wife in 2010, resulting in her sustaining several injuries.

The Office of the Attorney General, as counsel for Department of Public Safety Commissioner James C. Deleon Guerrero, asked the court to strike Radich’s declaration.

Assistant attorney general James Zarones said the Radich couple should have presented to the court their reason for filing the declaration and requested permission to file the amended declaration.

Instead, Zarones said, the Radich couple took it upon themselves to file the new declaration without permission, perhaps thinking it is easier to ask for forgiveness than for permission.
On Tuesday, U. S. District Court for the NMI Chief Judge Ramona V. Manglona dismissed the Radich couple’s lawsuit. In the same order, the judge denied as moot the OAG’s motion to strike the declaration.

In the new declaration, Radich said the CNMI law that prohibits him from owning a handgun significantly limits his ability to protect himself and his family in the event of violence.

At the same time, Radich said, his inability to obtain a Weapons Identification Card for self-defense purposes significantly limits his ability to protect himself and his family.

Radich and his wife, Li-Rong, applied with the Department of Public Safety for a Weapons Identification Card, but their applications have yet to be approved or denied.

Manglona had dismissed the lawsuit for lack of standing. The judge, however, allowed the Radich couple to file by March 24, 2015, an amended complaint to include the handgun import ban.

  1. Packing a .45 won’t protect you, or anyone else, from the perils of living and working within a tribal culture and corrupt oligarchy. But there will be lots more opportunities for “law abiding people [and not-so-law-abiding] to protect themselves” by shooting someone (a spouse or family member or lover or neighbor) in a fit of anger or upset and loss of self-control and then, just maybe, protect themselves from the consequences of their human weakness by taking their own life. Final, absolute, permanent protection from someone who may be upsetting you and your from your own errors.

    Did a firearm protect Alexander Hamilton from Aaron Burr? Did a firearm protect Aaron Burr from the consequences of killing Alexander Hamilton (who was also armed and a voluntary participant in the duel)?

    “A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear arms, shall not be abridged.” So where is the militia tradition in these islands? Just how does this constitutional language fit the CNMI?

    1. Those were scheduled confronted ” duel” as was the “custom” of the land in that time. ( to protect ones honor)
      Here, to protect “ones honor” we just “plumel” one because useing what ever is available and the victor will be the one that is the biggest or who has the biggest stick.( or any weapon.

      Now ‘upcoming’ maybe “the biggest gun”
      Same as the wild west gun fight and who was the fastest draw.
      It will seriously may be very interesting going into the 21 century, while we are still living in the 19th century. Awe!

  2. I cannot agree with Squid’s quibble about the headline. The point is that Mr. and Mrs. Radich are determined to be able own and possess handguns.

    I don’t know about that dismissal based on lack of “standing.” It does seem odd that they are suing without waiting for their application for a weapons license to be approved or disapproved. Refile including the import ban? How does that solve anything if their weapons license still hasn’t been decided? And knocking out the import ban won’t do them any good if ownership and possession are still illegal.

    1. It has been years on the application, one was denied because it stated For “self defense”. (from previous posts)

  3. As I am sure that you and others are aware of, a .45 cal is the best for close range personal protection. A relatively slow projectile, with a heavy impact, a small entry hole and about a baseball exit diameter.
    In comparison in the past,my 9mm, entry and exit only a small difference in size comparison (but still much internal damage)
    Then again .44 Magnum hand gun 258 grain Hollow point?? (softball, or better exit) and no victim testimoney.

      1. I have been around, but with the MV self centered egotistical greater than thou attitude know it all Zaldy, has “blocked” me from MV. after I proved him wrong on one editorial and other things. He has done this to many that have questioned him and his self centered mindset.
        Evr wonder why many of the old timers have disappeared from the MV poster and have changed their aliases. Many have challenged Zaldy many times and have proved him wrong.
        Typical Filipinio thinking and attitude of someone that has been in Saipan too long.

  4. To all residents of the cnmi. Have any of you, taken a person’s life…..Don’t answer you might incrimiNate yourself. Ill say it again, only the result of firing a gun/rifle will matter. /

  5. As I have posted before regarding above topic previously, One size don’t fit all. Each is regulated by their own merits under the constitution. Might fit well in mainland but not in “territories”. Different demographics and such. As I have said, I am a fed employee and see how constitution are applied in territories; be it commonwealth or just plain US territory. Not all things transcend.
