Employees granted transfer
Two nonresident workers were granted transfer relief after their previous employer told the Department of Labor its business was in the process of closing down.
The two workers, Marichris V. Ramos and Marcial V. Ramos Jr., were employed as kitchen operations supervisor and beverage supervisor by Garlic & Onion.com. Their labor permits expired on Nov. 26, 2003, but renewal applications were not submitted until Jan. 7, 2004, late by about 42 days. The applications were denied.
At a Jan. 27 hearing, the employer, who had operated a restaurant in the Capitol Bowling Center in Garapan, testified that the late filings were due to the “ongoing difficulties and uncertainties” regarding the business operations.
The employer further testified that he is no longer able to employ the employees.
Because the employees are not at fault in the late filing, Hearing Officer Maya B. Kara granted the transfer, giving both 45 days to find a suitable employer who must submit required documents within the time period. Their applications must include an updated health clearance, police clearance, and a copy of the order.
