Boy gets a new electric wheelchair, voice activated computer

Christopher Ray Indalgencio recently received a new electric wheelchair and a voice-activated computer from the Public School System.

Indalgencio, a student of Marianas High School, is suffering from an illness known as Duchene’s muscular dystrophy, a condition that impairs his mobility and use of arms.

PSS provided Indalgencio with the new equipment according to the settlement agreement signed by his mother Cheryl Indalgencio, his attorney, Bill Campbell, PSS officials and the Attorney General’s office.

Campbell sued PSS last year for alleged failure to provide Indalgencio with assistive technology services in violation of the American with Disabilities Act.

“Christopher is an exceptionally brilliant boy, but he needed assistance; he can be another Stephen Hawkings, the completely disabled who the Nobel prize for Physics” Campbell said.

“Sometimes it requires the adversarial process to achieve results,” he added.

Last June 28, US District Court Judge Alex Munson approved the settlement agreement, which was followed by the dismissal of the ADA case.

Aside from providing Indalgencio with a new motorized wheelchair and a lap top computer, the settlement also included the agreement to remove barriers and make the facilities at MHS accessible to Indalgencio and other students suffering from the same condition.

“With the careful guidance of US District Court and the cooperation of the Attorney General, we were able to achieve a fair for all and happy ending. We avoided a lengthy and costly court proceedings,” Campbell said. (MCM)
