No bail for Lizama

A Saipan man facing drug charges in the U.S. District Court was denied bail yesterday for his temporary release from jail due to potential threat to his family and the island community as well as possible continued drug dealings in his residence.

Juan Cruz Lizama also has shown reluctance in responding to questions from the U.S. Probation Office since his arrest by joint local and federal agents last June 16.
Because of these reasons, he will continue to be detained in the Division of Corrections in Susupe under the custody of both the CNMI and federal authorities.

Mr. Lizama is facing one count of possession with intent to distribute crystal methamphetamine, popularly known as “ice,” amounting to 1.4 grams. The court has set a preliminary hearing on his case on Friday.

Yesterday’s proceeding heard arguments on the motion to free him on bail. New CNMI Supreme Court Justice John A. Manglona sat in for District Judge Alex R. Munson who is off-island.

Based on testimonies on the motion presented by the prosecution, special Judge Manglona said releasing the defendant from jail could affect his wife and children as there is no guarantee that he would stop dealing drugs right in their own house.

But Perry Inos, the court-appointed defense counsel, argued that the prosecution has failed to come with further evidence to support its claim that the defendant continues to pose a threat to his family and the community.

Mr. Lizama is facing separate charges in the local Superior Court for illegal possession of seven ounces of marijuana and 1.4 grams of methamphetamine which were found in his bedroom. A bail of $20,000 was set for his release.
