Cases filed vs. alleged trespassers
The Commonwealth government has petitioned the Superior Court for damages against four Saipan residents for allegedly squatting on government-owned property located in Marpi.
Agricultural grazing permit holders George Q. Camacho, Jose L. Chong, Luis T. Camacho, and Eliceo Castro have been sued by the Department of Lands and Natural Resources for failure to vacate public premises previously designated as site for an environmental project.
The defendants have allegedly overstayed their welcome on government land without legal authority to do so.
DLNR is then seeking repossession of the Marpi Forest Area, with intention to collect damages for fair rental value and costs of removing all personal items of the alleged squatters from the public land.
DLNR is also seeking relief on pre and post judgment interest including attorney’s fees and other costs.
Earlier, a local resident who allegedly erected a semi-concrete residential structure on a public land designated for agriculture and cattle grazing, was sued by the Board of Public Lands for trespassing and other damages.
According to court documents, the Marianas Public Land Corporation last April 2, 1992 issued a one year permit to Regino T. Camacho for the use of a three-hectare public land in Marpi on which to perform agricultural and grazing activities.
According to the plaintiff, the defendant has likewise refused to vacate the property to date.
The government is suing the Mr. Camacho for damages including fair rental value and cost of restoring the land to its original condition, in addition to pre and post judgment interest as well as attorney’s fees and costs. (MM)
