Employer fined $200

The Department of Labor recently imposed a $200 penalty on an employer for failing to timely remedy the deficiencies in a labor permit application.

Hearing officer Maya B. Kara ordered employer Gloria L. Mesa to pay the fee within 30 days of the order, issued on Jan. 27, 2005.

According to the department, a renewal application for employee Rizal C. Dela Cruz was timely filed on Sept. 21 last year, and a notice of deficiency was issued the same day after the application lacked a health certificate, proof of tax compliance, and farmer’s declaration.

It was denied on Nov. 18, 2004 and was followed by an appeal.

At a Jan. 20 hearing, it was established that the employer submitted a health certificate on Nov. 3 but made no attempt to cure the other deficiencies until the date of the hearing, when the employer produced proof of tax compliance as well as a completed farmer’s declaration.

With the deficiencies cured, the department’s decision to deny was reversed. The application was remanded to the Processing Section but the permit would not be issued until the fine is paid.
