Employer fined for late filing of application

The Department of Labor has sanctioned an employer for its failure to file an employment application on time.

KK Corporation was instructed to pay a fine of $250 immediately after receiving the administrative order. Labor hearing officer Cinta Kaipat imposed the sanction as she reversed an earlier decision by the Division of Labor to deny KK Corp.’s application.

The order stemmed from an appeal filed by KK Corp. and employee Piao Yuzi requesting the Hearing Office to overturn the denial.

KK Corp. was seeking permission to hire Piao on an expiration transfer, but the application was denied because it was submitted 10 days late.

At the hearing, KK Corp. owner Koo Yong Hoi, through translator Cho Jin Koo, testified that he put the application in a drawer and simply forgot to file it.

Kaipat directed the Division of Labor to resume the processing of the application after KK Corp. presents proof that it had paid the $250 fine.

The hearing officer also gave any concerned party 15 days to appeal the administrative order to the Labor secretary. (Agnes E. Donato)
