Woman sued over bad check

A company sued a woman for allegedly issuing a bad check in the amount of $12,000.

In a civil action at the Superior Court, L & W Amusement Inc. said it took the check from Rita S. Benavente for value on Dec. 1, 2003.

The company’s lawyer, Michael White, said the check bounced when his client deposited it in the company’s bank account.

White said Benavente did not actually have an account with the Bank of Hawaii, where the check was to be drawn.

The company then sent Benavente a demand for payment of the check pursuant to the Bad Checks Act.

White said Benavente still owes the company some $4,042.32 in principal amount. He asked the court to compel the Benavente to pay the owed amount plus interest.
