Election panel set to certify candidates
All government employees who will be running for public office this coming November are being advised to go on leave as soon as they are certified as candidates for the 2005 general election.
The Commonwealth Election Commission tentatively plans to certify all 2005 general election candidates on the afternoon of either Aug. 9 or Aug. 10, 2005.
“All government employees should therefore plan to begin take annual leave or be on leave without pay status the day after the date they are certified as candidates… Depending on when the commission certifies the candidates, leave status could begin on Aug. 10 or 11, 2005,” the commission said in a statement.
The 1984 Compensation Adjustment Act, as amended, or 1 CMC § 8245 (i) in particular, provides that a Commonwealth government employee shall take a leave of absence from his or her Commonwealth government position immediately upon certification of his or her candidacy by the Commonwealth Election Commission and shall continue such leave status until such time that he or she is no longer a candidate for public office.
1 CMC § 8243 (a) defines “employee” to include independent services contractors, consultants, professional services contractors, full-time and part-time personnel and employees of federal programs who receive their paychecks from the Commonwealth government.
Employee does not include incumbent elected officials.
